Terms of Service

These terms are the agreement between you and SendGuard. They cover what we provide, what we expect from you, and what happens if something goes wrong. By creating an account, sending an email to a SendGuard address, or using the free preview check, you agree to them. If you are agreeing on behalf of a company, you confirm you are authorized to bind it.

SendGuard is a business tool, provided to businesses. It is not intended for consumers, and the statutory rights that apply to personal purchases do not apply to it.

Who we are

SendGuard is operated by The Good Spot Ltd (company number 11460271), a company registered in England and Wales ("SendGuard", "we", "us"). You can reach us about anything in these terms at legal@sendguard.io.

What SendGuard does — and what it does not do

You send a test campaign to an address we issue you. We analyze it — authentication, headers, content, links, and images — and return a report of what we found.

Our checks are diagnostic aids, not a guarantee. A clean report means our checks did not find a problem. It does not mean your campaign is free of errors, that every link will still work when your recipients click it, that your email will reach the inbox, or that your campaign complies with the law. Email changes underneath us: a link that resolves when we test it can break an hour later, and a sending domain can be misconfigured after we have checked it. You remain responsible for reviewing and approving everything you send, and for complying with the marketing, privacy, and anti-spam laws that apply to you.

Accounts and workspaces

You need an account to use the paid service. Keep your login credentials secure — you are responsible for what happens under your account, including anything your team members do. Tell us promptly at legal@sendguard.io if you think someone has gained access to it.

Each workspace gets its own address (for example, yourname@track.sendguard.io). Anything sent to that address is treated as submitted by you for checking. Your plan sets how many team members you can add; if you need more seats than your plan allows, upgrade before adding them.

The free preview check

The free check on our website lets you try SendGuard without an account. The test address we generate works for 24 hours, results stay viewable for 30 days, and use is rate limited. It is provided for evaluation, without any commitment on our side — we may change, limit, or withdraw it at any time, and you should not rely on it for campaigns you are about to send.

Trials

New organizations start with a 7-day free trial that includes up to 25 checks and requires no payment method. The trial does not convert on its own: it simply ends when the 7 days or 25 checks run out, whichever comes first, and we do not charge you for it. To keep using the paid service afterwards, you subscribe to a plan and pay at checkout; paid subscriptions then renew as described below until you cancel. Trials are for evaluating SendGuard — one per organization.

Fees and billing

Prices are shown on our pricing page in US dollars and exclude VAT, sales tax, and any other taxes, which we add where we are required to. Payments are processed by Stripe; by subscribing you also accept Stripe's terms for the payment itself.

Subscriptions renew automatically — monthly or annually, depending on the plan you chose — until you cancel. If you change plans mid-term, Stripe prorates the difference. If a payment fails, we may retry it and may suspend your access until it clears.

We may change our prices. For existing subscriptions, a price change takes effect at your next renewal, and we will give you at least 30 days' notice by email beforehand. If you do not accept the new price, cancel before that renewal.

Cancellation and refunds

You can cancel at any time from the billing settings in your account. Cancellation takes effect at the end of the period you have already paid for — you keep access until then, and we do not charge you again.

Fees already paid are not refundable, including for partial periods, unused checks, and downgrades. The trial exists so you can evaluate SendGuard before paying. This does not affect any refund we are required to give you by law.

Acceptable use

You agree not to use SendGuard to:

• send content that is illegal, infringing, defamatory, or that you do not have the right to send;
• submit real customer data — send test campaigns, not emails containing live personal data about your recipients;
• check campaigns for anyone whose sending you are not authorized to act on, or resell access to your account;
• target our link verification at systems you do not control, or use it to probe, load, or attack a third party;
• work around our rate limits, plan limits, or the expiry on preview checks, including by creating multiple accounts;
• scrape, reverse engineer, or copy the service, or use it to build a competing product;
• interfere with the service's operation or security, or attempt to access data that is not yours.

If you find a security issue, please report it to security@sendguard.io rather than exploiting it. We will not pursue you for good-faith research that respects these terms and gives us a reasonable chance to fix the problem.

Your content

The emails you submit stay yours. You give us a limited license to store, process, and analyze them solely to run your checks, show you results, and keep the service running securely. We do not use your campaigns to train models, sell them, or share them with anyone beyond the providers listed in our Privacy Policy.

You are responsible for having the rights to the content you submit. Where the emails you send us contain personal data, we handle it as described in our Privacy Policy, acting as your processor for that content.

Our intellectual property

SendGuard — the software, the checks, the way we present results, and our name and branding — belongs to us. These terms give you the right to use the service, not to own any part of it. The reports we generate for you are yours to use inside your business.

If you send us feedback or suggestions, we may use them to improve SendGuard without owing you anything for them.

Services we depend on

SendGuard runs on infrastructure and services provided by others — including Amazon Web Services, Stripe, WorkOS, and Neon — and checks links across the public internet. We are not responsible for outages, changes, or failures in services we do not control, including your email service provider.

Availability and disclaimers

We work to keep SendGuard available and accurate, but the service is provided "as is" and "as available". We do not commit to any particular level of uptime, and we may take the service down for maintenance. Except where we have separately agreed a written service level with you, we make no promises about availability, response times, or the completeness or accuracy of check results.

To the fullest extent the law allows, we exclude all warranties, conditions, and terms that would otherwise be implied — including any implied terms about satisfactory quality, fitness for a particular purpose, and non-infringement.

Limitation of liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, and to the fullest extent the law allows:

• We are not liable for the campaigns you send. That includes lost revenue, lost sales, wasted spend, reputational harm, or regulatory penalties arising from an error our checks did not detect, from a check result you relied on, or from a campaign you sent after using SendGuard.
• We are not liable for indirect or consequential loss, or for loss of profits, revenue, business, goodwill, anticipated savings, or data.
• Our total liability to you for all claims in any 12-month period is capped at the fees you paid us in the 12 months before the claim arose.

This allocation of risk is reflected in our pricing. If you need broader protection, contact us about an enterprise agreement.

Indemnity

You will cover us against claims, losses, and reasonable costs arising from the content you submit to SendGuard, from your use of the service in breach of these terms, or from campaigns you send.

Suspension and termination

We may suspend or close your account if you breach these terms, if your payment fails and stays unpaid, or if your use threatens the security or stability of the service or harms others. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.

You can stop using SendGuard at any time. When your account closes, your access ends and we handle your data as described in our Privacy Policy. Export anything you want to keep before you close it. The sections on your content, our intellectual property, liability, indemnity, and governing law survive termination.

Changes to the service and these terms

SendGuard evolves — we add checks, change how results are presented, and occasionally retire features. We may update these terms too. When we do, we will post the new version here and update the effective date. If a change materially reduces your rights, we will give account holders at least 30 days' notice by email; continuing to use SendGuard after that means you accept the new terms.

Governing law and disputes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them. Before starting proceedings, please contact us at legal@sendguard.io — most things are quicker to resolve by email.

General

These terms, together with our Privacy Policy, are the whole agreement between us about SendGuard and replace anything said beforehand. You may not transfer your rights under them without our consent; we may transfer ours as part of a merger, acquisition, or sale of assets. If a court finds part of these terms unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to enforce it later. Neither of us is liable for delays caused by events outside our reasonable control. There are no third-party beneficiaries to this agreement.
